The following terms and conditions outline your contract with Splash Art Republic Ltd ("we", "us", “the company” and "our"). Please read these carefully as they govern the relationship between us, and set out our respective rights and obligations. These Booking Conditions refer to "you" and "your" as the first named person on the booking and include all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.

Upon making a booking, the first named person on the booking (“the Lead Name”) agrees on behalf of all persons detailed on the booking that:-

  • He/she/they has read these terms and conditions and has the authority to and does agree to be bound by them.

  • He/she/they consents to our use of information in accordance with our Privacy Policy;

  • He/she/they is over 16 years of age and resident in the United Kingdom and where placing an order for services with age restrictions declares that he/she/they and all members of the party are of the appropriate age to purchase those services;

  • All information given to us is true and accurate

1. GENERAL

1.1. Nothing in these terms and conditions is intended to affect your statutory rights.

1.2. The trademarks and logos displayed on the website are the property of the company. You are not permitted to use these without a written consent of the company and you accept that any such use may constitute an infringement of the relevant proprietor’s rights.

1.3. These terms and conditions and any contract concluded incorporating these terms and conditions shall be governed by English law and all disputes shall be submitted to the exclusive jurisdiction of the English courts.

1.4. The website may contain hyperlinks to third party websites. The operation of those websites is out of the company’s control and you may use them at your own risk. The company accepts no liability for any damage arising out of any use of those websites.

1.5. The company collects and stores your personal details without disclosing it to any 3rd party and is dedicated to ensure that the privacy of your personal information is protected in accordance with the Data Protection Act 1998 and in accordance with GDPR.

1.6. The company may contact you from time to time with offers and promotions via email or phone.

1.7. The company is entitled to charge the guests for any damages which is intentional and/or caused by misuse of items. The Lead Name will be responsible for their group and takes full responsibility of said damages and will be charged accordingly.

1.8. While you are on our premises, you must ensure to conform to our codes and regulations, adopt proper standards of behaviour, and cooperate with our employees.

1.9. The company will not tolerate any kind of bullying or harassment or aggressive behaviour towards its employees. Any such behaviour may result in refusal of entry, session termination or removal from our site. Under such a scenario, no compensation, refund (in full or part) or re-booking of the session will be made by Splash Art Republic.

2. BOOKINGS OF ACTIVITIES AT SPLASH ART REPUBLIC

If you are booking on behalf of a group, please ensure that you have the consent of all members of the party before making a booking and that all members of your party have read and agree to be bound by these terms and conditions. The person who signs the booking form or completes the booking online will be the "lead name” for the purposes of the booking. The lead name must be 16 years of age or over at the time of booking. The lead name is responsible for payment of the total booking price, which may include any subsequent cancellation or amendment charges that may be payable. The lead name must confirm that all the other members of the party agree to be bound by these terms and conditions and provide accurate and full information to the remainder of the group in relation to the booking, including any subsequent changes.

2.1. Only person(s) who are at least 16 years of age are permitted to book an activity.

a)   2.2. Any person(s) who are under the age of 16 taking part in the activity must be accompanied by an adult:

b)   For children aged 4 to 7 years, we encourage people to purchase the Artist & Apprentice Shared Station. All children aged 4-7 years old (Apprentice) must be accompanied by an adult on an “Artist & Apprentice” booking. Adults are not able to supervise more than one Apprentice. A maximum of one adult and one child are permitted per station.

c)   All children aged 8-11 years old (Junior Artists) must have a responsible adult in the studio to supervise them. Adults must pay for their own station. We are unable to accommodate more than 8 children to 1 Adult due to health and Safety restrictions.

d)   All children aged 12-15 years old (Teen Artist) must have a responsible Adult on the premises but are not required to be in the studio with them.

e)   Unfortunately, due to the nature of our venue and very limited space in our Splash Art Studios, non-paying spectators cannot be admitted.

f)    If you arrive and have not booked the appropriate paying adult supervision for the activity / age range, you risk losing your booking and no refund shall be made. It is your responsibility to ensure that you have booked correctly.

2.3. In the event of any person(s) under the age of 16 taking part in a Splash Art Republic Activity, the Lead Name on the booking confirms that they shall accept responsibility for the welfare and behaviour of all those members of their group who are aged under 16.

2.4. This is a live event, and once the booking is confirmed, we cannot accept any cancellations or give any refunds. However, the company may reschedule the event once, in accordance with the following terms:

a)   If cancellations are more than 48 hours in advance of your booking we will reschedule your session free of charge.

b)   If cancellations are made less than 48 hours in advance of your booking you will not receive a refund. All bookings are final.

c)   If you are rescheduling between 48-24 hours in advance, you will incur a £10 rescheduling fee per station.

d)   We are unable to reschedule bookings with notice of 24 hours or less. In this case you will not receive a refund.

e)   If your whole party or an individual guest in a party does not show up to their booking, they will not receive a refund and do not have the option to reschedule.

f)    Any rescheduling after done must be confirmed by an email or in writing from the company and the Lead Name.

2.5. If Splash Art Republic should have to cancel or reschedule your booking for any reason, we will offer a 100% refund or offer an alternative date for your booking.

2.6. Any purchase on the website is only valid when processed by the company. You shall receive a confirmation once your booking is processed.

2.7. If you wish to transfer your booking(s) into someone else’s name, you must contact the company by either email or telephone at least two hours prior to the start of your booking. Your request may not be honoured and can be denied.

2.8. Bookings may not be transferred or resold for commercial purposes or at a premium. If a booking is transferred or resold in breach of this condition, the bearer of the booking or the person claiming the right to attend the event will be refused admission.

2.9. You are entirely responsible for entering your details correctly on the Online Booking Form.

2.10. You are responsible for your own time-keeping. If you do not arrive on time we reserve the right to cancel your booking. You must arrive 5-10 minutes before the event’s stated start time to allow for the event to start promptly. A booking becomes a no-show and entry will be declined if you are late by 20 minutes or more. In such a situation the money is not refundable and the booking will not be rescheduled.

2.11. You will not be permitted entry to Splash Art Republic earlier than 10 minutes prior to your booking slot. Our staff will be working with other visitors or preparing materials for your arrival.

3. SPECIAL REQUESTS

Any special requests must be advised to us at the time of booking. Although we will endeavour to meet any special requests, we regret we cannot promise that any requests will be complied with unless we have specifically confirmed this in writing. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed. We do not accept bookings that are conditional upon any special request being met.

4. ACCESS, DISABILITIES, MEDICAL ISSUES

4.1. Splash Art Republic (Nottingham) is located in a Georgian Grade II listed building. Access to our Splash Art Studio is on the first floor via a relatively steep spiral staircase which is part of the historical listing. There is no lift and we do not have accessible toilet facilities.  Our Pour Art Studio is on the ground floor although there is a step up from street level. Unfortunately, due to the historical nature of the building, it’s not greatly accessible for disabled people who have mobility issues. We are looking to develop more Splash Art Republic sites which are fully accessible throughout.

4.2. If you or any member of your party has any medical problem or disability which may affect the booking arrangements of that person, you must inform us in writing before booking so we can advise as to the suitability of the chosen booking and offer potential adaptions options to facilitate access requirements to the best of our ability. Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details.

4.3. Our venue is lively and can be very busy, particularly at weekends. We do have back ground music playing and the environment (particularly the splash art studio) has the potential to be overstimulating for neurodivergent guests and those who struggle with sensory overload / overstimulation. Please contact us before booking so we can recommend the most suitable session for your needs.

4.4. For disabled people who would not be able to attend our venue without the support of a carer or personal assistant, you may purchase an “Artists and Carer” ticket which admits one carer or personal assistant free of charge with a full price ticket. Please note, the carer or personal assistant WILL NOT be allocated materials to create their own artwork. To book this ticket you must provide valid proof of ID upon arrival. We accept the following documents:

  • Attendance Allowance Letter (AA)

  • Carers’ Allowance Letter of Award

  • Disability Living Allowance Letter (DLA)

  • Personal Independence Payments (PIP)

  • Valid Blue Badge

If no proof of identity is provided upon arrival, we reserve the right to charge the carer / support worker the cost of a full price ticket.

5. PRICE AND PAYMENT

5.1. The prices of our activities are stated on the website under the booking section.

5.2. The prices are set and non-negotiable.

5.3. Standard bookings and birthday parties and can be made online only. Full payment is required at the time of booking.

5.4. Group and corporate bookings can be made by phone, email or online form submission. A 50% deposit will be requested by payment link with the final balance due 14 days in advance of the booking.

5.5. In case of less people attending the event than it is booked for, the price difference will not be refunded.

5.6. Increasing the number of people attending an event must be approved by Splash Art Republic in writing, in advance to account for capacity issues. Price difference can be settled upon arrival to the event.

5.7. We reserve the right to amend the price of bookings at any time.

7. SAFETY

7.1. Each attendee will be instructed before their session by an employee of the company. After being briefed on the process, health and safety, our rules and expectations, each guest will participate at their own risk. The company is not liable for any (personal or equipment) damages caused by not following the rules described before the session and in the FAQ’s on our website.

7.2. Fire exits signs are clearly marked.

7.3. People (whom in our staff’s opinion) are excessively under the influence of alcohol or appear to have used drugs will not be admitted and their game stated as no-show.

7.4. Only soft drinks purchased from Splash Art Republic may be purchased on our premises.

7.5. You may bring a reasonable and not excessive amount of alcoholic drinks to our Adults Only sessions or private hire bookings.

7.6. To be admitted you must confirm the full name of the booker and might be asked to confirm phone number and email address the booking confirmation was sent to.                                                                                                                                                                 

7.7. By booking Splash Art Republic, you (“The Lead Name”) and all members of your group agree to be bound by the Terms and Conditions of sale specified herein. Splash Art Republic or its employees shall not be liable for any death, personal injury, loss or damage caused while in the venue, location or place related to Splash Art Republic (“Site”).

8. PHOTOS

8.1. Photos may be taken during your booking for use in our social media campaigns

8.2. Photos may be stored on our server for future use

8.3. Photos may be uploaded to social media sites without names.

9. WEBSITE USE AND SECURITY

9.1. The website http://www.splashartrepublic.co.uk hereinafter the website is owned and operated by Splash Art Republic the company. The company holds the right to amend or vary the terms and conditions below including any of the contents of this website from time to time at its sole discretion without prior notice.

9.2. The terms and conditions apply to the use of the website by any visitor and should be read carefully before any use.

9.3. The company does its best to supply you with the most up to date and accurate information on the website.

9.4. The website is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this website without the written consent of the company.

9.5. You are not permitted to link to, or use all, or any part of the website for any purpose which is fraudulent, unlawful, defamatory, harmful, obscene or objectionable.

9.6. You accept that the Internet is not fully secure. The company will take all appropriate steps to protect your information.
